Terms of Service - Updated Q2 2026

1. Overview

These Terms of Service (“Terms”) govern all services provided by East Bay Real Estate Videos (“Company,” “we,” “us,” or “our”). By booking or using our services, you (“Client”) agree to these Terms.

2. Services Provided

East Bay Real Estate Videos provides real estate media services, including but not limited to:

  • Photography

  • Videography

  • Aerial (drone) media

  • Floor plans (2D & 3D)

  • Virtual tours

  • Virtual staging

  • Social media content

Scope of work is defined at the time of booking or in written agreement.

3. Booking & Payment

3.1 Full payment is required to download assets. Assets can be previewed prior to payment.

3.2 Payment terms will be outlined at the time of order.

4. Cancellations & Rescheduling

4.1 48+ hours notice: No fee

4.2 Late cancellations or no-shows: May be charged up to the full service amount

4.3 Weather-related rescheduling will be handled at our discretion.

5. Property Readiness

The Client is responsible for ensuring the property is clean, staged, and ready at the scheduled time.

5.1 We do not move large items or clean properties

5.2 Time spent waiting or reshooting due to unprepared spaces may incur additional fees

5.3 If other vendors are working on site, late cancellation fee may apply

6. Turnaround Times

6.1 Typical delivery timelines:

  • Photos: 12-24 hours

  • Video: 2–5 business days

  • Matterport tours: 12 hours

  • Floor plans: 12-24 hours

6.2 Rush delivery may be available for an additional fee.

7. Revisions

7.1 2 revisions are included

7.2 Additional revisions beyond the original scope may incur fees

7.3 Requests must be submitted within 3 days of receipt of preview

8. Usage & Licensing

8.1 The Client is granted a limited, non-transferable license to use the media for marketing the specific property.

8.2 Media may not be resold, transferred, or reused for other listings without written permission.

8.3 Builders, stagers, or third parties must obtain separate licensing.


9. Ownership & Copyright

9.1 All media produced remains the property of East Bay Real Estate Videos LLC.

9.2 We reserve the right to:

  • Use content for marketing, portfolio, and promotional purposes

  • Share content on social media, website, and advertising

10. Virtual Staging Disclaimer

10.1 Virtual staging is for illustrative purposes only

10.2 Images must comply with applicable laws and MLS rules (including disclosure requirements such as those outlined in California AB 723)

10.3 The Client is responsible for ensuring proper disclosure when using virtually staged images

11. Liability

11.1 We are not responsible for issues related to property condition, staging, or accuracy of listing information

11.2 Our liability is limited to the cost of services provided

12. Access & Permissions

12.1 The Client confirms they have permission to grant access to the property and authorize media capture.

12.2 The Client agrees to indemnify the Company against any claims related to unauthorized access or use.

13. Delivery & Storage

13.1 Final media will be delivered digitally

13.2 Long-term storage of the files by East Bay Real Estate Videos is not guaranteed

13.3 Clients are responsible for downloading and backing up files

14. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control (weather, equipment failure, emergencies, etc.).

15. Governing Law

These Terms are governed by the laws of the State of California.

16. Agreement

By booking services, the Client acknowledges they have read, understood, and agreed to these Terms.
